There are many factors that courts consider when determining Child Custody in a Divorce, including who the primary caretaker of the child will be, and the importance of having both parents involved in the life of the child. Whether Child Custody is established by an agreement between the parents or by the court, it is necessary to address both legal and physical custody:

  • Physical Custody: Physical custody refers to the parent who provides the child's primary residence. The primary residential parent has the ability to manage day-to-day decisions affecting the child and is usually the parent who receives Child Support payments. In certain shared custody arrangements, the child has two primary residences, spending at least 35 percent of the time with each parent.
  • Legal Custody: Legal custody refers to the ability to make long-term decisions regarding the child's upbringing, such as education, religion and other critical issues. It is common for parents to share legal custody.
