The means test compares the average household income of the debtor (looking to the prior six-month's earnings) to the median household income of individuals in the same geographic region with the same household size. Generally, debtors whose income falls below the median income will qualify for Chapter 7 Bankruptcy, given other eligibility requirements are met. Household income above the median will trigger a more detailed analysis of necessary expenses and disposable income to determine if the debtor could possibly succeed in a Chapter 13 Bankruptcy instead.
